These Terms of Service (“Terms”) govern your use of GetMarkerMade.com and purchases made from Get Marker Made LLC (“Get MarkerMade,” “we,” “us,” or “our”). By using this website or placing an order, you agree to these Terms.
GetMarkerMade.com may be used by customers of all ages. If you are under 13, a parent or guardian should be involved when you provide personal information or place an order. If you are under the age of majority where you live, you should have permission from a parent or guardian to make a purchase.
Our Products
Get MarkerMade offers apparel and related products, including shirts designed for coloring, pre-colored designs, fully colored products, accessories, and products intended for groups or events.
We may add, modify, discontinue, or limit products, designs, sizes, versions, accessories, or other offerings at any time.
Product availability is not guaranteed until an order has been accepted and processed.
Orders, Pricing & Availability
We try to keep product descriptions, pricing, and availability accurate and up to date. However, prices, product details, and availability may change without notice. All orders are subject to acceptance by Get MarkerMade.
We reserve the right to refuse or cancel an order when reasonably necessary, including because of product availability, suspected fraud, misuse of the website, payment issues, or an obvious pricing or listing error.
If we discover an obvious pricing, product, or listing error, we may correct the error or cancel the affected order. If you have already been charged for an order that we cancel, we will issue a refund for the amount charged.
Payment, Taxes & Charges
Customers are responsible for providing current and accurate billing and payment information.
Prices displayed on the website may not include applicable sales tax, shipping charges, or other charges that are calculated during checkout.
Payments may be processed by third-party ecommerce or payment-processing providers. Their separate terms and privacy practices may also apply to your transaction.
Product Appearance & Variations
We make reasonable efforts to display our products accurately. However, colors may appear differently depending on your screen or device, and minor differences in print placement, sizing, or production may occur. These small variations are normal and do not necessarily mean that a product is defective.
Because many Get MarkerMade products are made to order, minor production variations may occur from one item to another.
Sizing
Customers are responsible for selecting the appropriate size before completing an order.
Measurements and sizing information provided on our Size Guide are intended to help customers make an informed selection. Garment measurements are approximate and may vary slightly because of normal manufacturing tolerances.
We encourage customers to compare our measurements with a shirt that already fits the way they prefer.
Coloring and Product Use
Certain Get MarkerMade shirts are intended to be colored by the customer.
Results may vary depending on the markers used, coloring technique, amount of ink applied, washing practices, and other factors outside our control.
When using fabric markers or other third-party products, customers should follow the instructions, age recommendations, warnings, and safety information provided by the manufacturer of those products.
Get MarkerMade may provide marker recommendations and coloring guidance through our Project Guide, but independently manufactured markers and supplies are not manufactured or controlled by Get MarkerMade.
Children should receive appropriate adult supervision when using markers or other art supplies based on the child’s age and the instructions for the products being used.
Shipping, Changes, Cancellations, Returns & Replacements
Order processing, shipping, order changes, cancellations, returns, refunds, damaged or incorrect items, and replacement claims are governed by our Shipping & Returns Policy.
By placing an order, you acknowledge that many Get MarkerMade products are made to order and that the rules stated in the Shipping & Returns Policy apply to your purchase.
Group Orders & Customization
Get MarkerMade may offer limited customization for qualifying group, event, camp, church, school, birthday, youth-group, or similar bulk orders.
Available customization may include simple information such as names, event details, organization information, or dates.
Acceptance of a customization request is at Get MarkerMade’s discretion. Customers are responsible for reviewing and approving any requested wording, spelling, dates, names, or other information before production when approval is requested.
Customers submitting logos, artwork, names, trademarks, photographs, or other materials for customization represent that they have the necessary rights or permission to use and provide those materials.
Customer-Submitted Content
You retain ownership of content you submit to Get MarkerMade.
When you provide photographs, artwork, customization materials, messages, or other content for an order, customer-service matter, replacement claim, or similar purpose, you give Get MarkerMade permission to use that content only as reasonably necessary to provide the requested service, process or fulfill the order, or resolve the matter for which it was submitted.
Content Submitted for Promotion
If you intentionally submit a testimonial, customer photo, finished-project image, contest entry, social-media feature submission, or other content specifically for promotional or marketing use, we may ask you to grant Get MarkerMade permission at the time of submission.
When you provide that permission, you grant Get MarkerMade a non-exclusive, royalty-free license to use, reproduce, display, publish, distribute, crop, resize, and make reasonable formatting edits to that submitted content for Get MarkerMade’s website, social-media channels, email marketing, advertising, and promotional materials, subject to applicable law and the permission presented when you submit the content.
You continue to own your original content.
If promotional content depicts a child or minor, the adult submitting the content must be the child’s parent or legal guardian or otherwise have authority to grant the requested permission.
Get MarkerMade Intellectual Property
Unless otherwise stated, the content on GetMarkerMade.com is owned by or licensed to Get MarkerMade.
This includes, where applicable:
- Get MarkerMade and MarkerMade names and branding
- logos
- mascots
- product designs
- illustrations
- graphics
- artwork
- photographs
- website design elements
- written content
- slogans
- other creative materials
You may not copy, reproduce, modify, republish, distribute, sell, commercially exploit, create unauthorized derivative works from, or otherwise use Get MarkerMade intellectual property without our permission except where applicable law expressly permits such use.
Purchasing a product does not transfer ownership of the underlying artwork, design, trademark, copyright, or other intellectual property appearing on that product.
Acceptable Use of the Website
You may not use GetMarkerMade.com in a way that is unlawful, fraudulent, abusive, harmful, or intended to interfere with the website or other customers.
You may not attempt to gain unauthorized access to the website or its systems, introduce malicious code, misuse checkout or promotional systems, scrape or reproduce website content for unauthorized commercial purposes, or impersonate another person or organization.
We may restrict access or cancel transactions when reasonably necessary to protect Get MarkerMade, our customers, or our systems from fraud, abuse, or misuse.
Third-Party Services & Links
GetMarkerMade.com may use or link to third-party services, including ecommerce, payment, shipping, social-media, analytics, or marketplace services.
We do not control third-party websites or services and are not responsible for their independent content, availability, terms, or privacy practices.
Your use of a third-party service may also be subject to that provider’s own terms and policies.
Get MarkerMade may separately sell products through marketplaces such as Etsy and TikTok Shop. Transactions made directly through those platforms may also be governed by the marketplace’s own terms and policies.
Disclaimer of Warranties
We work to provide accurate information, quality products, and a reliable shopping experience.
However, except for rights or warranties that cannot legally be excluded, GetMarkerMade.com and its content are provided on an “as available” basis, and we do not guarantee that the website will always be uninterrupted, error-free, or available.
Nothing in these Terms limits any warranty, remedy, or consumer right that cannot legally be waived or excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Get MarkerMade will not be responsible for indirect, incidental, special, or consequential losses arising from use of the website or products where such liability may lawfully be limited.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
This section does not change the remedies available under our Shipping & Returns Policy for eligible damaged, defective, or incorrect products.
Privacy
Your privacy is important to us.
Our collection and use of personal information is described in our Privacy Policy.
The Privacy Policy forms part of the policies governing your interaction with Get MarkerMade.
Governing Law
These Terms are governed by the laws of the State of North Carolina, without unnecessarily limiting consumer-protection rights that may legally apply based on where you live.
Nothing in these Terms is intended to waive rights that applicable consumer law does not allow you to waive.
Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
No Waiver
If Get MarkerMade does not immediately enforce a provision of these Terms, that does not mean we permanently waive our right to enforce that provision later.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, services, business practices, website, or legal requirements.
When we make changes, we will update the “Last Updated” date on this page.
Your continued use of GetMarkerMade.com after updated Terms become effective is subject to the updated Terms.
